Acceptance of Terms of Use
Welcome to Good Pill Pharmacy. We are a non-profit organization dedicated to improving medication access to those in need. This website is operated by Good Pill Pharmacy, LLC (“Good Pill Pharmacy,” “Good Pill,” “we,” or “us”). Good Pill offers this website (the “Site”) and any information or services delivered via this site or via email or phone communication (collectively the “Services”) to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
These Terms of Use (the “Terms”) are a binding contract between you (“you” or “user”) and Good Pill Pharmacy, LLC (“Good Pill Pharmacy,” “Good Pill,” “we,” or “us”). You must agree to and accept all of the Terms in order to have the right to use the Services. Your using the Services in any way means that you agree to all of these Terms, and these Terms will remain in effect while you use the Services. These Terms include the provisions in this document, as well as those in our privacy policy.
NOTICE: Please read these Terms carefully. They cover important information about Services provided to you. These Terms include information about future changes to these Terms, automatic refills, limitations of liability, and a class action waiver. We reserve the right to update, change or replace any part of these Terms of Use by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
General
You understand and agree that by using, browsing, or registering on goodpill.org, making payment or sending prescription(s) to Good Pill Pharmacy, or receiving medication(s) from Good Pill Pharmacy, you accept all of the Terms as stated here (https://www.goodpill.org/gp-terms). We reserve the right to refuse service to anyone for any reason at any time.
You understand and agree that Good Pill Pharmacy is a non-profit organization dedicated to improving medication access to those in need, and that we may waive fees on a case-by-case basis. You understand and agree that our Services are reserved for people whose income is at or below the income eligibility requirements of the Georgia Medicaid program, or who are uninsured, underinsured, or enrolled in a public assistance health benefits program such as Medicaid or Medicare. You understand that eligibility may vary on a case-by-case basis.
You understand and agree that the medication(s) you receive have been donated pursuant to Georgia Law and that Good Pill Pharmacy and its affiliated businesses are immune from civil or criminal liability and disciplinary action pursuant to this program.
Personal Health Information
Your submission of personal health information is governed by our Privacy Policy. You understand and agree to Good Pill Pharmacy’s Privacy Policy and understand that Good Pill Pharmacy is not a covered entity under HIPAA, and therefore is not obligated to follow HIPAA regulations.
You understand that your information may be transferred unencrypted and involve transmissions over various internal networks. You understand and agree that you will notify Good Pill Pharmacy of any known allergies, drug reactions, idiosyncrasies, and chronic conditions or disease states not otherwise noted. You understand and agree that Good Pill Pharmacy cannot be held liable for any missing information.
Consultation
Consultation is available if you have any questions regarding your prescription(s) or medication(s). For consultations, please email us at hello@goodpill.org or call at (888) 987-5187. A pharmacist on staff will be available to answer questions or concerns. You understand and agree that you have the right to consult our pharmacist about your prescription(s) or medication(s). You understand and agree that by not requesting consultation with a member of the Good Pill Pharmacy team, you are thereby refusing counseling.
Communication and Delivery
You understand and agree to receive communications from Good Pill Pharmacy about your prescription(s) by phone, text message, and email. You understand that these communications may contain personal health information and may be unencrypted.
You understand and agree to the delivery of your medication(s) by mail to a mailing address of your choice. You understand and agree that by entering your shipping address during registration, you are providing Good Pill Pharmacy with written authority to deliver your prescription(s) to that address, including but not limited to a practitioner’s office location.
Modifications to Services and Prices
You understand and agree to pay for and receive your prescription refills automatically unless you contact Good Pill Pharmacy to decline or delay the refill(s).
Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Services.
Accuracy, Completeness, and Timeliness of Information
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk. This site may contain certain historical information. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.
Accuracy, Completeness, and Timeliness of Services
You understand and agree that in the event of any issues or irregularities with an order, Good Pill Pharmacy shall attempt to remediate the situation in a timely manner. Transfers
You understand and agree that Good Pill Pharmacy may transfer your prescription(s) to and from other pharmacy(s) and may reach out to your prescriber(s) for new prescription(s).
You understand and agree that, because Good Pill Pharmacy relies on donated medications, we may not always have your medication(s) in-stock. You understand that we may need to transfer prescription(s) for out-of-stock medications to a different pharmacy. You understand that once we transfer prescription(s) to a different pharmacy, Good Pill Pharmacy forfeits responsibility for any issues with filling your prescription.
Fees and Billing
You understand and agree that any fees paid to Good Pill Pharmacy are handling fees that Good Pill Pharmacy charges for the Services, not prices for the medication(s). You understand that you may request the current usual and customary retail price of any brand or generic prescription drug or medical device that Good Pill Pharmacy publicly offers for sale.
Third-Party Platforms
You understand and agree that the Terms of Use stated here apply to Good Pill Pharmacy, and may not apply to other third-party platforms. Similarly, the Terms of Use for other third-party platforms may not apply to Good Pill Pharmacy.
Indemnification
You agree to indemnify and hold Good Pill Pharmacy, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys fees), made against Good Pill Pharmacy by any third party due to or arising out of or in connection to your violation of these Terms of Use, or with your use of the Services.
Governance and Arbitration
If any part of these Terms of Use is determined by a court of competent jurisdiction to be invalid or unenforceable, it will not affect any other provision of these Terms of Use, all of which remain in full force and effect. You agree that all matters, including all disputes, relating to your access to or use of Good Pill information or services or of our Service, including its Contents, will be governed by the laws of the State of Georgia without regard to its conflicts of laws provisions. You agree to the personal jurisdiction by and venue in the state and federal courts for Georgia, and waive any objection to such jurisdiction or venue. Any claim under these Terms of Use must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred. In the event of any controversy or dispute between Good Pill and you arising out of or in connection with your access to or use of Good Pill information or services or of our Service, including its Contents, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If we are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), then either party may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.
Damages, Liabilities, or Injury Disclaimers
1) Good Pill does not promise that our service or any content, service or feature of our service will be error-free or uninterrupted, or that any defects will be corrected, or that your use of our service will provide specific results.
Our Service and its content are delivered on an as-is and as-available basis, without representations or warranties of any kind. Good Pill cannot ensure that any files or other data you download from the site will be free of viruses or contamination or destructive features.
Good Pill disclaims all express or implied representations and warranties regarding the information, services, products, materials and any other resources available on or accessible through this service, including any warranties of accuracy, title, non-infringement, merchantability and fitness for a particular purpose.
Good Pill disclaims any and all liability for the acts, omissions and conduct of any third parties in connection with or related to your use of our service and/or any Good Pill services.
You assume total responsibility for your use of our service and any linked sites. Your sole remedy against Good Pill for dissatisfaction with our service or any content is to stop using our service or any such content. This limitation of relief is a part of the bargain between the parties.
The above disclaimer applies to any damages, liability or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorized access to, alteration of or use, whether for breach of contract, tort, negligence or any other cause of action. Good Pill reserves the right to do any of the following, at any time, without notice:
(i) to modify, suspend or terminate operation of or access to our Service, or any portion of our Service, for any reason;
(ii) to modify or change our Service, or any portion of our Service, and any applicable policies or terms; and
(iii) to interrupt the operation of our Service, or any portion of our Service, as necessary to perform routine or non-routine maintenance, error correction or other changes.
2) In no event will Good Pill be liable for any indirect, punitive, incidental, exemplary or consequential damages, including for loss of profits, good will, use, data or other intangible losses that result from:
(i) The use of or inability to use our service
(ii) The cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from our service
(iii) Unauthorized access to or alteration of your transmissions or data on our service
(iv) Statements or conduct of any third party on our service; or
(v) Any other matter relating to our service, whether in contract, negligence or other tortious action, even if Good Pill has been advised of or should have known of the possibility of such damages. In jurisdictions that do not allow the exclusion or limitation of liability for incidental or consequential damages, such limitation shall not be applicable to you.
If, notwithstanding the other provisions of these Terms of Use, Good Pill is found to be liable to you, any liability on the part of Good Pill will not exceed the fees paid by the user for the particular information or service provided. Good Pill is not liable for the unauthorized use of our Content by any other websites.
Modifications to Terms of Use
You understand and agree that Good Pill Pharmacy reserves the right, at any time or frequency, to update, revise, supplement, remove, and otherwise modify the Terms of Use and to impose new or additional rules, policies, terms, or conditions on your use of Good Pill Pharmacy services. Such updates, revisions, supplements, modifications, and additional rules, policies, terms, and conditions (collectively referred to as “Additional Terms”) do not require notice and will be effective immediately and incorporated into these Terms of Use. Your continued use of Good Pill Pharmacy services following will be deemed to constitute your acceptance of any and all such Additional Terms. All Additional Terms are hereby incorporated into the Terms of Use by this reference.
Entire Agreement
The failure of us to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision. These Terms of Use and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Use). Any ambiguities in the interpretation of these Terms of Use shall not be construed against the drafting party.
